Welcome to Kunya. These Terms of Service ("Terms") govern your access to and use of the Kunya website, applications, APIs, and all related services (collectively, the "Service") operated by Kunya ("we," "us," or "our").

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.

1. Eligibility

You must be at least 16 years of age (or the age of digital consent in your jurisdiction) to use the Service. By using the Service, you represent and warrant that you meet this requirement and have the legal capacity to enter into these Terms.

If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Account Registration

To access most features of the Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration.
  • Keep your account credentials secure and confidential.
  • Notify us immediately of any unauthorized use of your account.
  • Accept responsibility for all activity that occurs under your account.

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently.

3. Subscriptions & Payments

3.1 Paid Plans

Kunya offers paid subscription plans. By subscribing, you agree to pay the applicable fees as displayed at the time of purchase. All prices are listed in US dollars unless otherwise stated.

3.2 Billing Cycle

Subscriptions are billed on a recurring basis (monthly or annually, depending on your selected plan). Your subscription will automatically renew at the end of each billing cycle unless you cancel before the renewal date.

3.3 Payment Processing

Payments are processed by our third-party payment provider, Stripe. By providing payment information, you authorize us to charge your payment method for the subscription fees. You are responsible for keeping your payment information up to date.

3.4 Refunds

Subscription fees are generally non-refundable. However, if you experience a significant service disruption or billing error, please contact our support team and we will review your case on an individual basis.

3.5 Price Changes

We may adjust pricing from time to time. We will provide at least 30 days' notice before any price increase takes effect. Continued use of the Service after a price change constitutes acceptance of the new pricing.

4. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable law, regulation, or third-party rights.
  • Generate, distribute, or store content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable.
  • Generate content that exploits, harms, or endangers minors in any way.
  • Engage in harassment, hate speech, or discrimination of any kind.
  • Attempt to reverse-engineer, decompile, or extract the source code of the Service.
  • Circumvent or attempt to circumvent usage limits, rate limits, or access controls.
  • Use automated tools (bots, scrapers) to access the Service in a manner that exceeds reasonable use.
  • Impersonate any person or entity, or misrepresent your affiliation.
  • Distribute malware, viruses, or any other harmful software through the Service.
  • Use the Service to compete directly with Kunya or to build a substantially similar product.

We reserve the right to investigate and take appropriate action against anyone who violates these provisions, including removing content, suspending accounts, and reporting to law enforcement.

5. AI-Generated Content

5.1 Nature of AI Output

The Service provides access to third-party AI models that generate content based on your prompts. AI-generated content may be inaccurate, incomplete, biased, or inappropriate. You are solely responsible for reviewing, verifying, and deciding how to use any AI-generated content.

5.2 No Guarantees

We do not guarantee the accuracy, reliability, completeness, or fitness for any particular purpose of AI-generated content. The Service should not be relied upon for medical, legal, financial, or other professional advice.

5.3 Content Ownership

Subject to the rights of the underlying AI model providers, you retain ownership of the content you create using the Service (including prompts and AI outputs generated from your prompts), to the extent permitted by applicable law. You grant Kunya a limited license to process your content solely for the purpose of providing and improving the Service.

6. API Usage

If you access the Service through our API, you agree to the following additional terms:

  • Comply with all rate limits and usage quotas associated with your plan.
  • Keep your API key confidential and do not share it publicly.
  • Do not use the API to build a service that directly competes with Kunya.
  • Include appropriate attribution where required by the underlying AI model providers.
  • Implement reasonable error handling and respect retry-after headers.

We may revoke API access if we detect abuse, excessive usage beyond your plan limits, or violations of these Terms.

7. Intellectual Property

The Service, including its design, code, branding, logos, documentation, and all other materials (excluding user-generated content), is owned by Kunya and protected by intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent. The Kunya name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Kunya.

8. Third-Party Services

The Service integrates with third-party AI model providers (including but not limited to OpenAI, Anthropic, Google, Meta, xAI, and DeepSeek). Your use of AI models through Kunya is also subject to the terms and policies of the respective providers.

We are not responsible for the availability, accuracy, or policies of third-party services. If a third-party provider changes their terms, pricing, or discontinues a model, we will make reasonable efforts to find alternatives but cannot guarantee uninterrupted access to any specific model.

9. Privacy

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the practices described in the

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. We disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade.

We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not warrant the accuracy or completeness of any AI-generated content.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KUNYA AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, arising out of or related to your use of or inability to use the Service.

Our total aggregate liability for all claims arising from or related to the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless Kunya and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from:

  • Your use of the Service.
  • Your violation of these Terms.
  • Your violation of any third-party rights.
  • Content you create, submit, or distribute through the Service.

13. Termination

13.1 By You

You may cancel your subscription and close your account at any time through your Account Settings. Cancellation takes effect at the end of your current billing period. No refunds will be issued for partial billing periods.

13.2 By Us

We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms. In cases of serious violations (illegal activity, abuse, fraud), termination may be immediate.

13.3 Effect of Termination

Upon termination, your right to use the Service ceases immediately. We may delete your account data after a 30-day grace period. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and indemnification) will survive.

14. Modifications to the Service

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We will make reasonable efforts to notify you of significant changes. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Service.

15. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will:

  • Update the "Last Updated" date at the top of this page.
  • Notify you via email or an in-app notification for significant changes.
  • Provide at least 30 days' notice before changes that materially affect your rights.

Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms. If you do not agree to the changes, you should discontinue use of the Service.

16. Governing Law & Disputes

These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles. Any disputes arising from or relating to these Terms or the Service shall be resolved through good-faith negotiation first. If a resolution cannot be reached, disputes shall be submitted to binding arbitration or the courts of competent jurisdiction.

17. General Provisions

  • Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and Kunya regarding the Service.
  • Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
  • Waiver: Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.
  • Assignment: You may not assign or transfer your rights under these Terms without our written consent. We may assign our rights and obligations without restriction.
  • Force Majeure: We are not liable for any failure or delay in performance due to events beyond our reasonable control, including natural disasters, pandemics, war, terrorism, government actions, or internet/infrastructure failures.
